Terms of Service for Textures and Custom Products
These Terms of Service may be updated at any point in time and for any reason. Check back often to see if the TOS has changed.1. For the purposes of my TOS, "textures" refers to the png 2D image that wraps around a 3D model; "products" refers to whole asset (2D texture and 3D .fbx) that can be applied to a larger 3D model; and "version" refers to the individual model variations within a larger unity package.2. I own all rights to the advertisement of my textures and custom products. These items will be used in photographs and other advertisement material to promote my services.3. You can be denied service at any point in time and for any reason. If you are denied service, you are not entitled to a refund.4. Please provide 50% payment upfront when ordering a custom texture or product.5. If you make a payment on behalf of another patron, those funds will be credited towards that person's commission and are non-refundable.6. If we agree to an art trade, and you finish your side of the trade, but are not satisfied with your custom texture or product, you are not entitled to payment for the work you did for the trade.
6a. If I complete my side of the trade, but you do not produce your side at all, you will owe the price for your custom texture or product that I created.
6b. If you complete your side of the trade, but I am unable to complete my side for any reason, I will owe you the price for your work and product.
6c. I will only enter into an art trade agreement for work of equal value to the work I produce. To consider the trade completed, you must produce work of equal value to my own.7. If you would like a custom texture or product that I do not have the resources for, and the resources are not free, you will be expected to pay for the cost of the resources (ie. model, asset, etc.)8. Additional charges will be applied to additional work. (see pricing menu). I reserve the right to charge for additional extensive work that is not listed on my pricing menu.9. If you are not satisfied with your texture or custom product, I will work with you to come up with a solution. If no solution can be found, I will refund you 50% of the texture/product's cost. (I keep 50% to pay for my work and effort.) However, if you receive a refund, you relinquish rights to the defective texture/product, and the texture/product will become my property to do with as I wish.10. All textures given as part of the "freebies" section of Foxipaws' server may be used by anyone who owns the specified model. However, any additional products that are purchased as part of a bundle, where the texture is labeled as free but the products are not, or vice versa, are only for use by the buyer.
Terms of Service for Adoptables
1. For the purposes of my TOS, "adoptables" refers to the textures, custom products, and reference sheets that are sold together in a package bundle.2. I own all rights to the advertisement of my adoptables. These items will be used in photographs and other advertisement material to promote my services.3. These adoptables are not available for resale. If you no longer wish to own your adoptable, you may trade the adoptable or offer it for free.4. Once an adoptable is sold, it and its likeness belongs to the buyer unless stated otherwise. You may not use the adoptable or its likeness without the express permission of the buyer.5. Custom adoptables are also available (see pricing menu for custom textures.)
